Welcome to the mySBCERA web site (the “Site”) operated by the San Bernardino County Employees’ Retirement Association (SBCERA). To access this site, you must become a mySBCERA user by following the registration process. You are required to read and agree to this Agreement when registering. Registration of your Username and Password will not occur unless you check the box acknowledging agreement to the following Terms and Conditions.

Please note that your registration in mySBCERA serves as legally binding and enforceable consent. The resulting contract authorizes SBCERA to process electronically your retirement benefit information and, submitted by the user via mySBCERA, to update the user’s account information in the same manner as if communicated by other official means.

Portions of Site are © 2010 Levi, Ray & Shoup, Inc. (LRS) and licensed to SBCERA pursuant to a license agreement between LRS and SBCERA.

If you do not agree with these Terms and Conditions regarding electronic access issues, you may not access or otherwise use this Site. If you have any questions regarding these Terms and Conditions, please contact SBCERA (click on the Contact link at the top of the mySBCERA Login page).

Use of Member Direct

This Agreement takes effect when the SBCERA member, benefit recipient, or legal representative registers a Username and Password. This Agreement may be amended at any time by posting the Agreement as amended on this Site. Your continued use of this Site shall indicate your acceptance of the Agreement, as amended.

You are responsible for the confidentiality and use of your password. For your safety, never disclose your password to anyone. SBCERA will never request your user-defined Username or Password in any form of communication other than as required by one of the following three mySBCERA prompts: Registration, Login, and Forgot Your Password. If you have any evidence or suspect any unauthorized use of your password or account, or any other security violation, you must immediately notify SBCERA.

When accessing your mySBCERA account, never leave your computer unattended. It is also highly recommended that you close your Internet browser (e.g. Internet Explorer, Firefox) upon exiting/signing out from your account.

It is your responsibility to confirm any changes that you have made through this site by reviewing your confirmation e-mail sent by mySBCERA.

When you provide information to SBCERA through the Site, you agree to provide true, accurate, current and complete information about yourself. You also agree not to impersonate any person or entity, misrepresent any affiliation with another person, entity or association, or conceal your identity from SBCERA for any purpose.

You shall not attempt to or actually disrupt, interfere with, or alter the Site or Site content, nor shall you allow other persons to do the same. You shall not directly or indirectly collect or attempt to collect any information about others, including passwords, account or other information.

This Agreement incorporates SBCERA’s Disclaimer & Privacy Statement, and by accepting this Agreement, you acknowledge that you have read and understand that Statement.

Disclaimers

The Site is provided by SBCERA on an ‘as is’ and ‘as available’ basis. To the full extent permissible by applicable law, SBCERA disclaims all warranties, expressed or implied.

The information provided on the Site should not be solely relied upon, as it is based on currently available information that is subject to change. SBCERA, and its Trustees and employees, will not be liable for any errors in its content, or for any investment decisions or other actions that you take based on it. You should not rely on this information for investment, tax or legal advice.

mySBCERA users assume the risk of using this service. SBCERA, and its Trustees and employees, will not be liable to the mySBCERA user or anyone else for damages or claims of any kind arising from the use or misuse of this Site by anyone. Additionally, this agreement releases SBCERA from any claim of harm resulting from a circumstance beyond SBCERA’s control including, but not limited to, failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, or natural disasters.

Your remedy, if any, for damages related to your use of the Site is against SBCERA and not LRS.

Your access to the Site is governed by all applicable federal, state and local laws. In the case of a dispute, you agree that the laws of the State of California shall apply to this agreement. Actual or attempted unauthorized use of the Site may result in criminal and/or civil action. SBCERA reserves the right to view, monitor, and record activity on the Site without notice or permission from you. As dictated by legal requirements, we may share the information we gather with law enforcement agencies or other authorized entities.

The design of the mySBCERA website includes industry-standard security precautions to ensure a safe and secure user experience as described in the mySBCERA Privacy and Security Policy. The personal information that you provide through the Site is protected by encryption and a secure socket layer (SSL) connection, so it cannot be read as it is transmitted over the Internet. However, it is not possible for SBCERA to guarantee the safety and integrity of the Site. By agreeing to these Terms and Conditions, you acknowledge that the Internet is not an entirely secure network and that communications transmitted over the Internet may be lost, intercepted by third parties or altered.

E-mail is not necessarily secure against interception by third-parties. If you wish to communicate sensitive information to mySBCERA or to SBCERA, send the information via mail or telephone rather than e-mail.

This list of permissions and restrictions contained herein is not intended to be complete, but merely illustrative. SBCERA reserves the right in its sole and final judgment to determine whether your conduct violates conduct requirements for mySBCERA.

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions.
